Welcome to our excavator and loader rental service! By accessing or using our platform and services, you acknowledge and agree to the following Terms and Conditions. These terms serve as a binding agreement between you and our company. If you do not agree with any part of these terms, please refrain from using our services.
1. Eligibility
To rent our equipment, you must:
  • Be at least 18 years old or the legal age of majority in your jurisdiction.
  • Possess the necessary qualifications, certifications, or licenses (where applicable) to operate heavy machinery.
  • Provide accurate, current, and complete information during the rental process.
We reserve the right to deny service if any eligibility criteria are not met.
2. Rental Agreement
Upon renting equipment, you agree to:
  • Use the machinery responsibly and solely for lawful purposes.
  • Avoid subleasing or transferring the rented equipment to third parties without prior written consent.
  • Inspect the equipment upon delivery and notify us immediately of any defects or issues before use.
Failure to adhere to these conditions may result in termination of the rental agreement and additional charges for damages or misuse.
3. Payment Terms
  • Rental Fees: All fees, including daily rates, deposit amounts, and any applicable taxes, will be clearly stated in the rental agreement.
  • Payment Schedule: Payments must be made in full before equipment is released unless otherwise agreed upon.
  • Late Payments: Late payments may incur penalties or interest as outlined in the agreement.
  • Additional Costs: Any damage to the equipment, fuel charges, or extended rental periods will result in additional charges.
4. Delivery and Return
  • Delivery: We will deliver the equipment to the agreed location on the specified date. Delivery times are subject to availability and external factors.
  • Inspection Upon Return: Returned equipment will be inspected for damage, wear beyond normal usage, or missing components. The renter is responsible for repair or replacement costs for any identified issues.
  • Timely Return: Equipment must be returned on or before the agreed return date. Late returns may incur additional fees.
5. Responsibilities of the Renter
The renter assumes full responsibility for the care and operation of the equipment, including but not limited to:
  • Operating the equipment only under suitable conditions to prevent damage.
  • Ensuring proper storage and security to avoid theft or vandalism.
  • Reporting any breakdowns, malfunctions, or accidents immediately.
Neglect, misuse, or unauthorized modifications will result in liability for repair or replacement costs.
6. Maintenance and Repairs
Routine maintenance of the rented equipment is our responsibility unless otherwise stated in the agreement. However:
  • The renter must not perform any repairs without prior authorization.
  • Any damage caused during the rental period that is not due to normal wear and tear will be the renter’s responsibility.
7. Insurance and Liability
  • Insurance Coverage: The renter may be required to provide proof of liability or equipment insurance before renting.
  • Accidents and Damages: The renter is liable for any damages or injuries caused by improper use of the equipment.
  • Limitation of Liability: We are not liable for losses resulting from the equipment's unavailability, failure, or delays caused by circumstances beyond our control.
8. Cancellation Policy
  • Cancellations by the Renter: Cancellations must be made at least 48 hours before the scheduled rental date to avoid penalties.
  • Cancellations by Us: We reserve the right to cancel or postpone rentals due to unforeseen circumstances such as severe weather or equipment issues. In such cases, we will notify you promptly and provide alternative solutions or a full refund.
9. Prohibited Activities
The following activities are strictly prohibited during the rental period:
  • Using the equipment for illegal activities.
  • Overloading or exceeding the equipment’s specified capacity.
  • Operating under the influence of alcohol, drugs, or other impairing substances.
Violation of these terms may result in immediate termination of the rental agreement without refund.
10. Force Majeure
We are not liable for delays, interruptions, or failures to fulfill our obligations due to events beyond our control, including natural disasters, labor strikes, or governmental actions.
11. Dispute Resolution
In the event of a dispute, the parties agree to resolve matters amicably through negotiation. If unresolved, disputes will be settled through arbitration in accordance with the governing laws of the applicable jurisdiction.
12. Amendments to Terms
We reserve the right to update these Terms and Conditions at any time. Updated terms will be posted on our platform and will take effect immediately. Continued use of our services constitutes acceptance of the updated terms.
13. Final Provisions
  • Entire Agreement: These Terms and Conditions, along with the rental agreement, represent the entire agreement between the parties.
  • Severability: If any provision of these Terms is deemed unenforceable, the remaining provisions will remain valid and enforceable.
  • No Waiver: Failure to enforce any part of these Terms does not constitute a waiver of our rights.
